1. A booking fee of $500.00 is payable with this contract and the balance of $1000.00, plus all unpaid expenses will be payable upon receipt of an invoice or prior to shipment of semen, whichever is first.  In the event breeding is purchased through a stallion service auction a $500 non refundable chute fee is applicable for all contracts. The Booking fee is non-refundable. 18% Interest will be charged on all accounts in excess of thirty days.

2. A photostatic copy of registration papers (both sides), a veterinarian's health certificate, including uterine culture, worming, and immunization records must accompany this contract.

3. The Mare Owner shall agree that each mare offered for breeding shall be in sound breeding condition and free from infection or disease. Any mare certified by the attending veterinarian not to be, in his opinion, in sound breeding condition, shall not be bred. Mare Owner may substitute another mare within that breeding season.

4. The Breeder agrees to diligently try and settle the above named mare and shall have sole discretion of determining the best method of breeding such mare. If however, the mare does not settle, the Breeder shall be held harmless. There will be no guarantee of a live foal for any mare leaving Simons Show Horses on or before being checked safe in foal by the attending veterinarian.

5. Live Foal Guarantee. Live foal means the foal shall stand and nurse. It is understood that if the mare proves barren, aborts her foal or if the foal is stillborn, a return season will be guaranteed the following year only, providing proper notification is given. Proper notification shall be defined as follows: Written certification by a licensed veterinarian within seven days that the mare has slipped or produced a non-viable foal. Mare Owner certifies that such abortion or death did not result from any act or omission of the Owner.  A breeders certificate will be issued to mare Owner upon request after all expenses have been paid in full and upon notification of birth of the foal. We request that breeders report the result of their cross, ex: overo filly, breeding stock colt, etc.

6. Color Foal Guarantee: If the resulting foal is not eligible for regular paint registry, the mare may be rebred in the current season, provided a chute fee of $500 is paid.

7. There is a chute fee of $250 if your mare did not get infoal from the previous year's breeding.

A breeders certificate will be issued to mare Owner upon request and after all expenses have been paid in full.

8. Waiver of Liability. It is understood that the breeding farm, its owners, employees, veterinarians, and guests shall not be liable for any injury, escape, disability, or death of any horse on its premises. The above named Mare Owner, whose horse (s) are under the care of Simons Show Horses will not be liable or responsible for any damage, injury or death to the breeding farm stallions, employees, veterinarians, or other animals in the care of Simons Show Horses whether or not caused by his horse.

9. The breeding season shall begin Feb.1st and close June 20th of the year covered by this contract. Shall the said mare need semen on a date not covered by this contract, a $150 collection charge will be charged to the mare owner.  It is further agreed that should the above named stallion die, or become unfit for service; or, if the above named mare dies, during the breeding season then the Mare Owner may substitute another mare or breed the above named mare to another stallion on the farm that is agreed to by both the Mare Owner and Breeder.

10. Mare owner or a representative may pick up semen at farm for a charge of $150.

11.  Orders for shipments are filled on a first come, first served basis. Orders must be placed by  5 pm central standard time the night before the necessary collection day. The mare owner is responsible for shipping charges for cancellations received after shipment has already been sent. Shipment orders cannot be guaranteed if they are placed via e-mail, you must call to confirm.

12.  Owner must notify Simons Show Horses of the date of insemination and confirmation that the mare is in foal.

13. When the above named Mare Owner signs and returns one copy of this contract to the Breeder it will then be a binding contract on both parties, subject to the terms and conditions. Under Texas Law (Chapter 87, Civil Practice and Remedies Code) This contract is not valid unless completed in full.

14. All payments may be made by Check, Visa, MasterCard or American Express and all funds must be US.  If paying by check leave Credit Card form blank.  There will be a 3% fee added for using a credit card.
